Whenever there are financial matters to resolve within a divorce, separation, dissolution we also encourage you to resolve difficulties without Court proceedings.
If you are married or in a civil partnership, the starting point is that both of you have a claim on any of the assets of the other and a joint liability for any debts. It is important to find out what is in the “pot” and then try to reach an agreement.
You will both need to provide each other with full and frank disclosure of your financial circumstances from which we can advise you on what would be an appropriate settlement.
If an agreement cannot be reached the court can decide what the settlement should be. There are various factors which the Court has to take into account and we can discuss these with you in more detail.
If you are not married or in a civil partnership the law is completely different. There is no such thing as common law husband and wife, however long you have lived together. It is important that you take specialist advice as soon as possible.
