Divorce & Separation

We can help you in all aspects of divorce and separation. Usually there is no need to go to Court for a divorce. A divorce starts with a petition being sent to the Court. This explains why you want a divorce. If you have children, another form is sent as well, giving information to the Court about the proposed arrangements for the children.

These forms are then sent to your spouse who sends an acknowledgement of service form to the Court. If the divorce is not defended, you can then apply for the Decree Nisi. This means that the Court confirms the divorce can go ahead, but you have to wait six weeks before you can apply for the Decree Absolute, so that if there is any reason why the divorce should not proceed, this can be raised in the six week period.

Usually you just have to wait the six weeks and then you can apply for the Decree Absolute. The Decree Absolute is the formal ending of the marriage. If for some reason you do not apply for the Decree Absolute then your spouse can apply for it three months later as long as they give notice of this to you. This would lead to a Court hearing.

In most divorces, it is not necessary for anyone to have to attend Court about the divorce itself.
